Acceptable Behaviour
Agreement (ABA)
Is a written agreement made between the
individual, mhs homes and the police. The individual may agree to
stop specific behaviour that has been causing a nuisance to others.
This is not legally binding.
Floating support
A service provided to vulnerable people, to
include the elderly, people with mental health problems or learning
difficulties, people suffering from the affects of drug or alcohol
abuse, and those not coping in their home. Each case is treated
individually and in complete confidence.
Mediation
Medway mediation is an independent body who
can help resolve disputes, it aims to help all people involved to
reach an agreement which they are all satisfied with.
Notice of seeking Possessions (NOSP)
This is the notice generally served, when
tenancy conditions have been breached, and prior to applying to
court for a possession order. In serious cases we can serve notice
and apply to court the same day, in other cases we may give
28 day notice.
Possession proceedings
This is the action mhs homes can take to end a
tenancy after having served notice of seeking possession. If we
have enough evidence we will apply to the county court for
possession of the property. If the case is proved a possession
order can be granted, and the person responsible for the anti
social behaviour can be evicted.
Trial tenancies
These are short-hold tenancies, initially
lasting 12 months. During this time if complaints are received
about anti social behaviour this may be grounds for the tenant to
fail the tenancy. This means that at the end of the probationary
period the tenant would have to leave the property.
