Family Break Up
Both partners in a married or civil partnership have the right
to stay in the home. The type of tenancy you have may depend
on how mhs homes assist you with your housing needs. Please
discuss this with your Neighbourhood Officer.
If you cannot agree who is to leave, you should apply to the
court for a decision. The court will decide based on its assessment
of the circumstances and will normally put any childrens interests
first to ensure that they do not become homeless.
Domestic Violence
If you are forced to leave your home due to acts of violence or
the threat of violence you should seek legal advice and contact the
police. You can ask to see your Anti Social
Behaviour officer in a location where you feel safe for
advice.

Succession (where a tenant dies)
Your partner or family member may be able to take over your
tenancy if you die. If the tenancy was joint, the surviving tenant
will automatically succeed to the tenancy.
The following are entitled to take on the tenancy:
- A husband, wife or partner (including same sex couples) who was
living in the property as their only or principal home before the
death of their partner. A close family member (such as a child,
brother or sister) provided that they have been living with the
tenant for at least 12 months before the death and are over 18
years old.
