How will we deal with Anti Social Behaviour?
Once a complaint of anti-social behaviour has been received,
someone from mhs homes will contact you within 72 hours to discuss
the complaint. This will be either your Housing Officer or the
Anti-Social Behaviour Officer.
If the incident involves racial harassment or domestic violence
contact will be made within 24 hours.
The mhs homes Anti-Social Behaviour Officer will contact the
party you have reported to us within 5 working days, to discuss the
complaint with them.
At all times we will keep your identity confidential.
We will provide you with written confirmation of the action being
taken within 10 working days
If the problem persists, you will be required to complete log
sheets of any incidents, and further investigation will be carried
out to correlate these complaints. This information forms the
beginning of our evidence for any future court proceedings
undertaken.
Once the investigation is completed, and the complaints have
been verified we will send a final warning letter to the
perpetrator, warning them that the behaviour must cease within
7 days or further action will be taken.
If we have evidence and providing the behaviour is of a serious
nature and sustained, we will serve Notice Of Seeking
Possession, which enables us to consider the use of legal action to
gain possession of the property. We can for example, apply for an
eviction, or an anti social behaviour injunction.
Legal Action - Will I have to go to
court?
If the anti social behaviour continues despite verbal and
written warnings from us we would consider possession proceedings.
In this instance we would be looking for complainants to attend
court. We are aware that the prospect of going to court worries
some people but the complainant will receive full support form
us throughout the whole process.
In most cases of anti social behaviour, court and legal action
is a last resort, and is only necessary in a minority of cases.
